This article discusses the history of the use of inverse condemnation in water damage cases and summarizes the current status of the law. The fundamental basis of the law in this area has been changed several times by decisions of the California Supreme Court. The article seeks to clear up the confusion resulting from these changes and provides opinions as to how the courts will deal with unanswered questions.
